No Covid Passports For Nightclubs In Andalucia
Andalucia’s top court has denied a request from the Junta to enforce the use of “covid passports” in nightclubs and hotels. The TSJA says that whilst the measure does meet the standards for neccessity and suitablility, the proposal failed on proportionality. The order would have been applied to every person needing to enter a hotel or hospitality venue, including staff, which the court found unacceptable.
The court considered the implications of the order on casual or temporary workers, who would need to pay for PCR tests (if not fully vaccinated) everytime they attended a hospitality venue. Because vaccination is not mandatory in Spain, the ruling would have also impacted workers who rely on this sector for their income.
