Spain is certainly seeing an upturn in property activity this year, we’re already seeing prices creep back up a little, compared to the last few years. These bargains won’t last long. Bank repossessions are beginning to run out and new complexes are being built around the more popular parts of the Costa del Sol.

Some Advice…
The Law
Get a Spanish lawyer who speaks your language – we’re taking mainly to the English speakers – there are many, many English speaking lawyers on the Costa del Sol. Here are a couple of completely random and unaffiliated examples – www.andalusianlawyers.com or www.malagalaw.com.
Before signing anything, consult your lawyer.
Make sure all contract and legal documents are written in a language you can understand. It may cost you to have these documents translated, but it will be worth it.
Keep your legal representation separate from your estate agent or property consultant. Your agent is a salesperson, after all, your lawyer only has your own interests to consider.
Documents
Your lawyer will guide you through the maze of administration, but here is a list of the more basic documents you should keep in mind…
Nota Simple. Shows that no mortgages/debts are registered against the property.
Numero Catastral. A certificate of Referencia Catastral. The number itself appears on the IBI receipt. This is a separate land registry which concentrates on the actual site location as opposed to the ‘Land Registry’ which concentrates on Title and Ownership. It is essential to check that both registries’ description of a property do not differ greatly. If it does it can mean there are problems and it should be checked to confirm which is correct
IBI Receipt. Local taxes up to date.
Community Documents. If you are buying in a Community, get a receipt for paid-up community charges and a copy of the Statutes and/or minutes. A copy of the minutes will give you a very good idea of the general ‘tone’ of the community your buying in to. Remember, you’ll be knowing these people for as long as you’re here.
Habitation Licence. There appear to be various versions of Habitation Licences. They all seem to do the same thing – to prove that your property is legal, registered and safe to live in – but you may hear of Certificaciones de No Infracciones, or
Escritura. It’s the property lease.
Copies of owner’s paid up bills for electricity, water, rubbish collection and the telephone
If you’re buying from a non-resident, try to get proof of payment of any fees and taxes, plus the 5% Hacienda deposit.
Lastly, many solicitors recommend which bank you should use, particularly if you are giving them Power of Attorney. Do ensure that the bank has English or your native language speaking staff. You’ll run in to all sorts of problems if you can’t speak with your bank, and changing banks can be a nightmare.
